Re\u0161er\u0161i mezin\u00e1rodn\u00edho typu (ITS) prov\u00e1d\u00ed org\u00e1n pro mezin\u00e1rodn\u00ed re\u0161er\u0161i (ISA) ve vztahu k n\u00e1rodn\u00ed patentov\u00e9 p\u0159ihl\u00e1\u0161ce, kter\u00e1 je pod\u00e1na u n\u00e1rodn\u00edho \u00fa\u0159adu, s c\u00edlem, v souladu s PCT, nal\u00e9zt nejrelevantn\u011bj\u0161\u00ed dokumenty o stavu techniky, kter\u00e9 se vztahuj\u00ed k p\u0159edm\u011btu n\u00e1rokovan\u00e9mu v p\u0159ihl\u00e1\u0161ce.<\/p>\n
C\u00edl ITS<\/strong><\/p>\n C\u00edlem ITS je nal\u00e9zt dosavadn\u00ed stav techniky, kter\u00fd je relevantn\u00ed pro ur\u010den\u00ed, zda a do jak\u00e9 m\u00edry je n\u00e1rokovan\u00fd vyn\u00e1lez, jeho\u017e se n\u00e1rodn\u00ed patentov\u00e1 p\u0159ihl\u00e1\u0161ka t\u00fdk\u00e1, nov\u00fd a zda zahrnuje vyn\u00e1lezeckou \u010dinnost. Na z\u00e1klad\u011b v\u00fd\u0161e uveden\u00e9ho bu\u010f ISA vyhotov\u00ed zpr\u00e1vu o re\u0161er\u0161i mezin\u00e1rodn\u00edho typu (ITSR), nebo vyd\u00e1 prohl\u00e1\u0161en\u00ed o nevyhotoven\u00ed ITSR. Postup<\/strong><\/p>\n \u017d\u00e1dosti o ITS lze podat u n\u00e1rodn\u00edho patentov\u00e9ho \u00fa\u0159adu, jeho\u017e p\u0159\u00edslu\u0161n\u00fd n\u00e1rodn\u00ed patentov\u00fd z\u00e1kon stanovuje mo\u017enost po\u017e\u00e1dat o re\u0161er\u0161i mezin\u00e1rodn\u00edho typu. V sou\u010dasn\u00e9 dob\u011b je mo\u017en\u00e9 pod\u00e1vat \u017e\u00e1dosti o ITS u n\u00e1sleduj\u00edc\u00edch n\u00e1rodn\u00edch \u00fa\u0159ad\u016f smluvn\u00edch st\u00e1t\u016f VPI na z\u00e1klad\u011b jejich p\u0159\u00edslu\u0161n\u00fdch n\u00e1rodn\u00edch patentov\u00fdch z\u00e1kon\u016f:<\/p>\n Ma\u010farsk\u00fd \u00fa\u0159ad du\u0161evn\u00edho vlastnictv\u00ed, \u017d\u00e1dost o ITS mus\u00ed b\u00fdt pod\u00e1na p\u0159\u00edmo u n\u00e1rodn\u00edho \u00fa\u0159adu, u kter\u00e9ho prob\u00edh\u00e1 \u0159\u00edzen\u00ed o n\u00e1rodn\u00ed patentov\u00e9 p\u0159ihl\u00e1\u0161ce. Formul\u00e1\u0159 \u017e\u00e1dosti o ITS<\/strong><\/p>\n Formul\u00e1\u0159 \u017e\u00e1dosti v p\u0159\u00edslu\u0161n\u00e9m jazyce n\u00e1rodn\u00edch \u00fa\u0159ad\u016f ke sta\u017een\u00ed na n\u00e1sleduj\u00edc\u00edch str\u00e1nk\u00e1ch: Lh\u016fty a dod\u00e1n\u00ed<\/strong><\/p>\n Visegr\u00e1dsk\u00fd patentov\u00fd institut vypracuje ITS do t\u0159\u00ed m\u011bs\u00edc\u016f od data, kdy byl Visegr\u00e1dsk\u00e9mu patentov\u00e9mu institutu doru\u010den formul\u00e1\u0159 \u017e\u00e1dosti i poplatek. Poplatek<\/strong><\/p>\n Poplatek za ITS se plat\u00ed p\u0159\u00edmo Visegr\u00e1dsk\u00e9mu patentov\u00e9mu institutu.
