Slu\u017eba re\u0161er\u0161e na novost (NSS), poskytovan\u00e1 Visegr\u00e1dsk\u00fdm patentov\u00fdm institutem (VPI), je prov\u00e1d\u011bna podle Dohody o Visegr\u00e1dsk\u00e9m patentov\u00e9m institutu (VPI). NSS je VPI slu\u017ebou glob\u00e1ln\u00ed patentov\u00e9 re\u0161er\u0161e, o n\u00ed\u017e m\u016f\u017ee po\u017e\u00e1dat kdokoli na cel\u00e9m sv\u011bt\u011b bez ohledu na st\u00e1tn\u00ed p\u0159\u00edslu\u0161nost.<\/p>\n

C\u00edl slu\u017eby re\u0161er\u0161e na novost (NSS)<\/strong><\/p>\n

Slu\u017eba re\u0161er\u0161e na novost (NSS) poskytuje informace o dosavadn\u00edm stavu\/stavu techniky pro dan\u00fd vyn\u00e1lez\/technick\u00e9 \u0159e\u0161en\u00ed. NSS zji\u0161\u0165uje patentov\u00e9 dokumenty a jin\u00e1 zve\u0159ejn\u011bn\u00ed, kter\u00e9 lze zohlednit p\u0159i posuzov\u00e1n\u00ed novosti a po\u017eadavku na vyn\u00e1lezeckou \u010dinnost u popisovan\u00e9ho vyn\u00e1lezu.<\/p>\n

NSS m\u016f\u017ee b\u00fdt u\u017eite\u010dn\u00e1 v \u0159ad\u011b situac\u00ed, nap\u0159\u00edklad p\u0159i p\u0159\u00edprav\u011b patentov\u00e9 p\u0159ihl\u00e1\u0161ky, v situaci vym\u00e1h\u00e1n\u00ed, p\u0159i jedn\u00e1n\u00ed s investory, p\u0159i vyu\u017e\u00edv\u00e1n\u00ed patentu (ud\u011blov\u00e1n\u00ed licenc\u00ed, prodej, zah\u00e1jen\u00ed v\u00fdroby, investice do dovozn\u00edch nebo v\u00fdvozn\u00edch aktivit atd.) nebo p\u0159i ur\u010dov\u00e1n\u00ed mo\u017en\u00fdch sm\u011br\u016f v\u00fdzkumu a v\u00fdvoje.<\/p>\n

Postup<\/strong><\/p>\n

Na popis vyn\u00e1lezu nebo technick\u00e9ho \u0159e\u0161en\u00ed nejsou kladeny \u017e\u00e1dn\u00e9 form\u00e1ln\u00ed po\u017eadavky. Nicm\u00e9n\u011b pro maxim\u00e1ln\u00ed vyu\u017eit\u00ed slu\u017eby se doporu\u010duje uv\u00e9st obdobn\u011b podrobn\u00e9 informace o p\u0159edm\u011btu vyn\u00e1lezu jako v patentov\u00e9 p\u0159ihl\u00e1\u0161ce.<\/p>\n

Slu\u017eba re\u0161er\u0161e na novost (NSS) se prov\u00e1d\u00ed v datab\u00e1z\u00edch patentov\u00e9 a nepatentov\u00e9 literatury pokr\u00fdvaj\u00edc\u00edch minim\u00e1ln\u00ed dokumentaci podle Smlouvy o patentov\u00e9 spolupr\u00e1ci (PCT).<\/p>\n

NSS se zpracov\u00e1v\u00e1 v angli\u010dtin\u011b. Objedn\u00e1vkov\u00fd formul\u00e1\u0159 pro NSS se proto vypl\u0148uje v angli\u010dtin\u011b a v\u0161echny dokumenty mus\u00ed b\u00fdt p\u0159edlo\u017eeny v angli\u010dtin\u011b. Zpr\u00e1va o re\u0161er\u0161i na novost (NSR) se rovn\u011b\u017e vyd\u00e1v\u00e1 v angli\u010dtin\u011b.<\/p>\n

Objedn\u00e1vky na NSS se pod\u00e1vaj\u00ed vypln\u011bn\u00edm objedn\u00e1vkov\u00e9ho formul\u00e1\u0159e pro glob\u00e1ln\u00ed patentov\u00e9 slu\u017eby. Objedn\u00e1vkov\u00fd formul\u00e1\u0159 se zas\u00edl\u00e1 po\u0161tou nebo e-mailem p\u0159\u00edmo Sekretari\u00e1tu VPI.<\/p>\n

Visegr\u00e1dsk\u00fd patentov\u00fd institut vypracuje zpr\u00e1vu o re\u0161er\u0161i na novost (NSR) do \u010dty\u0159 t\u00fddn\u016f od data potvrzen\u00ed objedn\u00e1vky, kter\u00e9 je vyd\u00e1no, pokud je k dispozici objedn\u00e1vka se v\u0161emi pot\u0159ebn\u00fdmi informacemi umo\u017e\u0148uj\u00edc\u00edmi smysluplnou re\u0161er\u0161i na vyn\u00e1lez a VPI byl zaplacen poplatek za slu\u017ebu.<\/p>\n

NSR obsahuje stru\u010dn\u00fd p\u0159ehled citovan\u00fdch dokument\u016f (patentov\u00fdch dokument\u016f a jin\u00fdch \u00fadaj\u016f o stavu techniky) s uveden\u00edm jejich relevance k vyn\u00e1lezu prost\u0159ednictv\u00edm p\u0159\u00edslu\u0161n\u00fdch mezin\u00e1rodn\u00edch k\u00f3d\u016f kategori\u00ed, tj. k\u00f3d\u016f X, Y a A.<\/p>\n

Poplatek<\/strong><\/p>\n

Vyhotoven\u00ed zpr\u00e1vy o re\u0161er\u0161i na novost (NSR) je zpoplatn\u011bno pau\u0161\u00e1ln\u00ed \u010d\u00e1stkou 650 EUR. Poplatek se hrad\u00ed bankovn\u00edm p\u0159evodem p\u0159\u00edmo na n\u00ed\u017ee uveden\u00fd \u00fa\u010det Visegr\u00e1dsk\u00e9ho patentov\u00e9ho institutu p\u0159i zad\u00e1n\u00ed objedn\u00e1vky.<\/p>\n
