Postup mezin\u00e1rodn\u00edho p\u0159edb\u011b\u017en\u00e9ho pr\u016fzkumu<\/strong><\/p>\n

Pot\u00e9, co p\u0159ihla\u0161ovatel obdr\u017e\u00ed p\u00edsemn\u00fd posudek org\u00e1nu pro mezin\u00e1rodn\u00ed re\u0161er\u0161i, m\u016f\u017ee po\u017e\u00e1dat o mezin\u00e1rodn\u00ed p\u0159edb\u011b\u017en\u00fd pr\u016fzkum. Jedn\u00e1 se o druh\u00e9 posouzen\u00ed patentovatelnosti vyn\u00e1lezu, kter\u00e9 prov\u00e1d\u00ed org\u00e1n pro mezin\u00e1rodn\u00ed p\u0159edb\u011b\u017en\u00fd pr\u016fzkum, obvykle na z\u00e1klad\u011b pozm\u011bn\u011bn\u00e9 verze p\u0159ihl\u00e1\u0161ky<\/strong> (ka\u017ed\u00fd org\u00e1n pro mezin\u00e1rodn\u00ed re\u0161er\u0161i p\u016fsob\u00ed rovn\u011b\u017e jako org\u00e1n pro mezin\u00e1rodn\u00ed p\u0159edb\u011b\u017en\u00fd pr\u016fzkum). V\u00fdsledn\u00e1 mezin\u00e1rodn\u00ed p\u0159edb\u011b\u017en\u00e1 zpr\u00e1va o patentovatelnosti d\u00e1le napom\u00e1h\u00e1 p\u0159ihla\u0161ovateli p\u0159i rozhodov\u00e1n\u00ed, zda vstoupit do n\u00e1rodn\u00ed f\u00e1ze<\/strong>.<\/p>\n

C\u00edlem mezin\u00e1rodn\u00edho p\u0159edb\u011b\u017en\u00e9ho pr\u016fzkumu nen\u00ed ud\u011blit nebo zam\u00edtnout patent, ale z\u00edskat p\u0159edb\u011b\u017en\u00fd a nez\u00e1vazn\u00fd<\/strong> n\u00e1zor ohledn\u011b toho, zda je n\u00e1rokovan\u00fd vyn\u00e1lez nov\u00fd<\/strong>, zahrnuje vyn\u00e1lezeckou \u00farove\u0148<\/strong> a je pr\u016fmyslov\u011b vyu\u017eiteln\u00fd<\/strong>.<\/p>\n

Vedlej\u0161\u00edm c\u00edlem je zjistit, zda nem\u00e1 mezin\u00e1rodn\u00ed p\u0159ihl\u00e1\u0161ka nedostatky ve form\u011b \u010di obsahu, nap\u0159\u00edklad s ohledem na jasnost n\u00e1rok\u016f, popisu a v\u00fdkres\u016f, nebo zda maj\u00ed n\u00e1roky \u00faplnou podporu v popise.<\/p>\n

Lh\u016fta pro pod\u00e1n\u00ed n\u00e1vrhu na pr\u016fzkum<\/strong><\/p>\n

P\u0159ihla\u0161ovatel mus\u00ed podat n\u00e1vrh u p\u0159\u00edslu\u0161n\u00e9ho org\u00e1nu pro mezin\u00e1rodn\u00ed p\u0159edb\u011b\u017en\u00fd pr\u016fzkum p\u0159ed uplynut\u00edm pozd\u011bj\u0161\u00ed z n\u00e1sleduj\u00edc\u00edch lh\u016ft:<\/p>\n

1.<\/strong> t\u0159i m\u011bs\u00edce ode dne, kdy byla p\u0159ihla\u0161ovateli p\u0159ed\u00e1na zpr\u00e1va o mezin\u00e1rodn\u00ed re\u0161er\u0161i a p\u00edsemn\u00fd posudek vypracovan\u00fd podle pravidla 43bis.1, nebo prohl\u00e1\u0161en\u00ed uveden\u00e9 v \u010dl\u00e1nku 17 (2) (a) PCT; nebo<\/p>\n

2.<\/strong> 22 m\u011bs\u00edc\u016f od data priority mezin\u00e1rodn\u00ed p\u0159ihl\u00e1\u0161ky.<\/p>\n

Sou\u010dasn\u011b s pod\u00e1n\u00edm n\u00e1vrhu je t\u0159eba uhradit p\u0159\u00edslu\u0161n\u00e9 poplatky, tj. jednac\u00ed poplatek a poplatek za p\u0159edb\u011b\u017en\u00fd pr\u016fzkum ve prosp\u011bch org\u00e1nu pro mezin\u00e1rodn\u00ed p\u0159edb\u011b\u017en\u00fd pr\u016fzkum.<\/p>\n

Visegr\u00e1dsk\u00fd patentov\u00fd institut vyd\u00e1 mezin\u00e1rodn\u00ed p\u0159edb\u011b\u017enou zpr\u00e1vu o patentovatelnosti nejpozd\u011bji do 28 m\u011bs\u00edc\u016f od data priority, leda\u017ee do\u0161lo k n\u00e1sleduj\u00edc\u00ed okolnosti:<\/p>\n

I<\/strong>nternational Search<\/h2>\n

The international search (IS) is carried out by an International Searching Authority (ISA) concerning an international patent application which is filed with a Receiving Office (RO), in order to find the most relevant prior art documents regarding the claimed subject matter in the application.<\/p>\n

The objective of the international search is to discover prior art which is relevant for the purpose of determining whether, and if so, to what extent, the claimed invention to which the international application relates is or is not novel and does or does not involve an inventive step. Based on the above, the International Searching Authority (ISA) establishes either an International Search Report (ISR) or a Declaration of non-establishment of ISR.<\/p>\n

I<\/strong>nternational P<\/strong>reliminary E<\/strong>xamination (IPE)<\/h2>\n

The international preliminary examination (often referred to as \u201cChapter II\u201d) is an optional part of the processing of an international patent application.<\/p>\n

The aim of the international preliminary examination is not to grant or refuse a patent, but to obtain a preliminary and non-binding opinion as to whether the claimed invention appears to be novel, to involve an inventive step and to be industrially applicable.<\/p>\n

S<\/strong>upplementary I<\/strong>nternational S<\/strong>earch (SIS)<\/h2>\n

The supplementary international search service offers applicants the choice to request additional searches from ISAs other than the one that carried out the initial PCT search. This service gives applicants the option of obtaining a more complete overview of the prior art in the international phase by allowing them to have an additional search performed in an ISA\u2019s specialty language.
