Visegr\u00e1dsk\u00fd patentov\u00fd institut je jedn\u00edm z ISA, kter\u00e9 nab\u00edzej\u00ed dopl\u0148kov\u00e9 mezin\u00e1rodn\u00ed re\u0161er\u0161e.<\/p>\n

Re\u0161er\u0161e<\/strong><\/p>\n

Dopl\u0148kov\u00e1 mezin\u00e1rodn\u00ed re\u0161er\u0161e m\u00e1, krom\u011b minim\u00e1ln\u00ed dokumentace PCT, zahrnout alespo\u0148 dokumenty v \u010de\u0161tin\u011b, ma\u010far\u0161tin\u011b, pol\u0161tin\u011b a sloven\u0161tin\u011b, kter\u00e9 jsou ve sb\u00edrce VPI<\/strong>.<\/p>\n

P\u0159ihla\u0161ovatel\u00e9 mohou po\u017e\u00e1dat o zpr\u00e1vu o dopl\u0148kov\u00e9 mezin\u00e1rodn\u00ed re\u0161er\u0161i jin\u00fd – dopl\u0148kov\u00fd org\u00e1n ISA do 19 m\u011bs\u00edc\u016f od data pod\u00e1n\u00ed (priority). Dopl\u0148kov\u00e1 mezin\u00e1rodn\u00ed re\u0161er\u0161e se prov\u00e1d\u00ed na PCT p\u0159ihl\u00e1\u0161ku, jak byla pod\u00e1na:<\/p>\n

\u2022 Org\u00e1n pro dopl\u0148kovou re\u0161er\u0161i (SSA) zah\u00e1j\u00ed dopl\u0148kovou re\u0161er\u0161i nejpozd\u011bji do uplynut\u00ed 22 m\u011bs\u00edc\u016f od data priority,<\/p>\n

I<\/strong>nternational Search<\/h2>\n

The international search (IS) is carried out by an International Searching Authority (ISA) concerning an international patent application which is filed with a Receiving Office (RO), in order to find the most relevant prior art documents regarding the claimed subject matter in the application.<\/p>\n

The objective of the international search is to discover prior art which is relevant for the purpose of determining whether, and if so, to what extent, the claimed invention to which the international application relates is or is not novel and does or does not involve an inventive step. Based on the above, the International Searching Authority (ISA) establishes either an International Search Report (ISR) or a Declaration of non-establishment of ISR.<\/p>\n

I<\/strong>nternational P<\/strong>reliminary E<\/strong>xamination (IPE)<\/h2>\n

The international preliminary examination (often referred to as \u201cChapter II\u201d) is an optional part of the processing of an international patent application.<\/p>\n

The aim of the international preliminary examination is not to grant or refuse a patent, but to obtain a preliminary and non-binding opinion as to whether the claimed invention appears to be novel, to involve an inventive step and to be industrially applicable.<\/p>\n

S<\/strong>upplementary I<\/strong>nternational S<\/strong>earch (SIS)<\/h2>\n

The supplementary international search service offers applicants the choice to request additional searches from ISAs other than the one that carried out the initial PCT search. This service gives applicants the option of obtaining a more complete overview of the prior art in the international phase by allowing them to have an additional search performed in an ISA\u2019s specialty language.
