Additional search for a more complete overview of the prior art<\/h2>\n

 <\/p>\n

The supplementary international search service offers applicants the choice to request additional searches from ISAs<\/strong> other than the one that is carried out in the initial PCT search. This service gives applicants the option to obtain a more complete overview of the prior art<\/strong> in the international phase by allowing them to have an additional search performed in an ISA\u2019s specialty language. The Visegrad Patent Institute is one of the ISAs that offer supplementary international searches.<\/p>\n

The Search<\/strong><\/p>\n

The supplementary international search shall, in addition to the PCT minimum documentation, cover at least the documents in Czech, Hungarian, Polish and Slovak, held in the collection of the VPI<\/strong>.<\/p>\n

The Process and Delivery Time<\/strong><\/p>\n

Applicants can request a supplementary international search report by a supplementary ISA up to 19 months from the filing (priority) date. The supplementary international search is carried out concerning the PCT application as filed.<\/p>\n

\u2022 The Supplementary International Searching Authority (SISA) begins the supplementary search at the latest by the expiration of 22 months from the priority date,<\/p>\n

\u2022 The supplementary international search report (SISR) shall be established within 28 months from the priority date. The SISR is transmitted to the PCT applicant and the International Bureau.<\/p>\n

Filing<\/strong><\/p>\n

A request for a supplementary international search shall be filed with the International Bureau (WIPO)<\/strong>.<\/p>\n

Fees<\/strong><\/p>\n

The supplementary search fee and supplementary search handling fee<\/strong> shall be paid to the International Bureau<\/strong> within one month from the date of receipt of the supplementary search request (Rule 45bis.3(c) PCT).<\/p>\n

The PCT is an international treaty that makes it possible to seek patent protection simultaneously in a large number of countries by filing a single application. Granting the patent remains under the national or regional legislation.<\/p>\n

I<\/strong>nternational Search<\/h2>\n

The international search (IS) is carried out by an International Searching Authority (ISA) concerning an international patent application which is filed with a Receiving Office (RO), in order to find the most relevant prior art documents regarding the claimed subject matter in the application.<\/p>\n

The objective of the international search is to discover prior art which is relevant for the purpose of determining whether, and if so, to what extent, the claimed invention to which the international application relates is or is not novel and does or does not involve an inventive step. Based on the above, the International Searching Authority (ISA) establishes either an International Search Report (ISR) or a Declaration of non-establishment of ISR.<\/p>\n

I<\/strong>nternational P<\/strong>reliminary E<\/strong>xamination (IPE)<\/h2>\n

The international preliminary examination (often referred to as \u201cChapter II\u201d) is an optional part of the processing of an international patent application.<\/p>\n

The aim of the international preliminary examination is not to grant or refuse a patent, but to obtain a preliminary and non-binding opinion as to whether the claimed invention appears to be novel, to involve an inventive step and to be industrially applicable.<\/p>\n

S<\/strong>upplementary I<\/strong>nternational S<\/strong>earch (SIS)<\/h2>\n

The supplementary international search service offers applicants the choice to request additional searches from ISAs other than the one that carried out the initial PCT search. This service gives applicants the option of obtaining a more complete overview of the prior art in the international phase by allowing them to have an additional search performed in an ISA\u2019s specialty language.
