Az IPE-folyamat<\/strong><\/p>\n

Az ISA \u00edr\u00e1sbeli v\u00e9lem\u00e9ny\u00e9nek k\u00e9zhezv\u00e9tel\u00e9t k\u00f6vet\u0151en a bejelent\u0151 nemzetk\u00f6zi el\u0151vizsg\u00e1latot k\u00e9rhet. Ez a tal\u00e1lm\u00e1ny szabadalmazhat\u00f3s\u00e1g\u00e1nak m\u00e1sodik \u00e9rt\u00e9kel\u00e9se, amelyet a nemzetk\u00f6zi el\u0151vizsg\u00e1lati szerv (IPEA) v\u00e9gez, \u00e1ltal\u00e1ban a bejelent\u00e9s egy m\u00f3dos\u00edtott v\u00e1ltozata alapj\u00e1n<\/strong> (minden ISA egyben IPEA is). Az \u00edgy elk\u00e9sz\u00fcl\u0151, szabadalmazhat\u00f3s\u00e1gr\u00f3l sz\u00f3l\u00f3 nemzetk\u00f6zi el\u0151vizsg\u00e1lati jelent\u00e9s tov\u00e1bbi seg\u00edts\u00e9get ny\u00fajt a bejelent\u0151nek ahhoz, hogy eld\u00f6ntse, bel\u00e9pjen-e a nemzeti szakaszba<\/strong>.<\/p>\n

A nemzetk\u00f6zi el\u0151vizsg\u00e1lat c\u00e9lja nem a szabadalom megad\u00e1sa vagy a bejelent\u00e9s elutas\u00edt\u00e1sa, hanem egy el\u0151zetes \u00e9s jogilag k\u00f6ter\u0151vel nem b\u00edr\u00f3 v\u00e9lem\u00e9ny<\/strong> kialak\u00edt\u00e1sa arr\u00f3l, hogy az ig\u00e9nyelt tal\u00e1lm\u00e1ny \u00fajnak<\/strong> tekinthet\u0151-e, feltal\u00e1l\u00f3i tev\u00e9kenys\u00e9gen<\/strong> alapul-e \u00e9s iparilag alkalmazhat\u00f3-e<\/strong>.<\/p>\n

A m\u00e1sodlagos<\/strong> c\u00e9l annak a meg\u00e1llap\u00edt\u00e1sa, hogy vannak-e a nemzetk\u00f6zi bejelent\u00e9snek alaki vagy tartalmi<\/strong> hi\u00e1nyoss\u00e1gai<\/strong>, p\u00e9ld\u00e1ul az ig\u00e9nypontok, a le\u00edr\u00e1s \u00e9s a rajzok egy\u00e9rtelm\u0171s\u00e9ge tekintet\u00e9ben, illetve hogy az ig\u00e9nypontokat teljes m\u00e9rt\u00e9kben al\u00e1t\u00e1masztja-e a le\u00edr\u00e1s.<\/p>\n

A k\u00e9relem beny\u00fajt\u00e1s\u00e1nak hat\u00e1rideje<\/strong><\/p>\n

A k\u00e9relmez\u0151nek a k\u00e9relmet az illet\u00e9kes IPEA-hoz az al\u00e1bbi hat\u00e1rid\u0151k k\u00f6z\u00fcl a k\u00e9s\u0151bb lej\u00e1r\u00f3 hat\u00e1rid\u0151 el\u0151tt kell beny\u00fajtania:<\/p>\n

1.<\/strong> a PCT V\u00e9grehajt\u00e1si Szab\u00e1lyzat\u00e1nak 43bis.1 szab\u00e1lya szerint elk\u00e9sz\u00edtett nemzetk\u00f6zi kutat\u00e1si jelent\u00e9snek \u00e9s az \u00edr\u00e1sos v\u00e9lem\u00e9nynek, vagy a PCT 17. cikk (2) bekezd\u00e9s a) pontja szerinti nyilatkozatnak a bejelent\u0151h\u00f6z val\u00f3 tov\u00e1bb\u00edt\u00e1si napj\u00e1t k\u00f6vet\u0151 h\u00e1rom h\u00f3nap; vagy<\/p>\n

2.<\/strong> a nemzetk\u00f6zi bejelent\u00e9s els\u0151bbs\u00e9gi napj\u00e1t k\u00f6vet\u0151 22 h\u00f3nap.<\/p>\n

A megfelel\u0151 d\u00edjakat, azaz a tov\u00e1bb\u00edt\u00e1s \u00e9s az el\u0151vizsg\u00e1lat d\u00edj\u00e1t a k\u00e9relemnek a nemzetk\u00f6zi el\u0151vizsg\u00e1lati szervhez t\u00f6rt\u00e9n\u0151 beny\u00fajt\u00e1s\u00e1val egyidej\u0171leg kell az IPEA-nak megfizetni.<\/p>\n

A Visegr\u00e1di Szabadalmi Int\u00e9zet a szabadalmazhat\u00f3s\u00e1gr\u00f3l sz\u00f3l\u00f3 nemzetk\u00f6zi el\u0151vizsg\u00e1lati jelent\u00e9st ad ki az els\u0151bbs\u00e9g napj\u00e1t\u00f3l sz\u00e1m\u00edtott 28 h\u00f3napon bel\u00fcl, kiv\u00e9ve ha<\/p>\n

\u2022 elmulasztott\u00e1k a nemzetk\u00f6zi el\u0151vizsg\u00e1lati szerv felh\u00edv\u00e1s\u00e1val kapcsolatos hat\u00e1rid\u0151ket (k\u00e9sedelmes d\u00edjfizet\u00e9s vagy d\u00edjfizet\u00e9s elmulaszt\u00e1sa, ford\u00edt\u00e1s k\u00e9sedelmes beny\u00fajt\u00e1sa, nyilv\u00e1nval\u00f3 hib\u00e1k kijav\u00edt\u00e1sa, stb. tekintet\u00e9ben).<\/p>\n

A PCT II. fejezet\u00e9hez k\u00f6t\u0151d\u0151 d\u00edjakat k\u00f6zvetlen\u00fcl az IPEA r\u00e9sz\u00e9re kell megfizetni. L\u00e1sd az \u00e9rv\u00e9nyes illet\u00e9kt\u00e1bl\u00e1zatot.<\/p>\n

I<\/strong>nternational Search<\/h2>\n

The international search (IS) is carried out by an International Searching Authority (ISA) concerning an international patent application which is filed with a Receiving Office (RO), in order to find the most relevant prior art documents regarding the claimed subject matter in the application.<\/p>\n

The objective of the international search is to discover prior art which is relevant for the purpose of determining whether, and if so, to what extent, the claimed invention to which the international application relates is or is not novel and does or does not involve an inventive step. Based on the above, the International Searching Authority (ISA) establishes either an International Search Report (ISR) or a Declaration of non-establishment of ISR.<\/p>\n

I<\/strong>nternational P<\/strong>reliminary E<\/strong>xamination (IPE)<\/h2>\n

The international preliminary examination (often referred to as \u201cChapter II\u201d) is an optional part of the processing of an international patent application.<\/p>\n

The aim of the international preliminary examination is not to grant or refuse a patent, but to obtain a preliminary and non-binding opinion as to whether the claimed invention appears to be novel, to involve an inventive step and to be industrially applicable.<\/p>\n

S<\/strong>upplementary I<\/strong>nternational S<\/strong>earch (SIS)<\/h2>\n

The supplementary international search service offers applicants the choice to request additional searches from ISAs other than the one that carried out the initial PCT search. This service gives applicants the option of obtaining a more complete overview of the prior art in the international phase by allowing them to have an additional search performed in an ISA\u2019s specialty language.
