Mi\u0119dzynarodowe badanie wst\u0119pne (cz\u0119sto okre\u015blane jako “Rozdzia\u0142 II”) jest opcjonaln\u0105 cz\u0119\u015bci\u0105 rozpatrywania mi\u0119dzynarodowego zg\u0142oszenia patentowego<\/strong>.<\/p>\n

Procedura IPE<\/strong><\/p>\n

Po otrzymaniu pisemnej opinii ISA, zg\u0142aszaj\u0105cy mog\u0105 wyst\u0105pi\u0107 o opcjonalne mi\u0119dzynarodowe badanie wst\u0119pne. Jest to powt\u00f3rna ocena zdolno\u015bci patentowej wynalazku przeprowadzona przez IPEA, zwykle na zmienionej wersji zg\u0142oszenia<\/strong> (wszystkie ISA s\u0105 tak\u017ce IPEA). Powsta\u0142y w wyniku oceny wst\u0119pny raport mi\u0119dzynarodowy na temat zdolno\u015bci patentowej dodatkowo pomaga zg\u0142aszaj\u0105cemu w ustaleniu, czy przej\u015b\u0107 do fazy krajowej<\/strong>.<\/p>\n

Celem mi\u0119dzynarodowego badania wst\u0119pnego nie jest udzielenie lub odmowa udzielenia patentu, ale uzyskanie wst\u0119pnej i nie wi\u0105\u017c\u0105cej opinii<\/strong> na temat tego, czy zastrzegany wynalazek jest nowy<\/strong>, posiada poziom wynalazczy i ma zastosowanie przemys\u0142owe<\/strong>.<\/p>\n

Celem drugorz\u0119dnym<\/strong> jest ustalenie, czy wyst\u0119puj\u0105 ewentualne usterki co do formy lub tre\u015bci<\/strong> zg\u0142oszenia mi\u0119dzynarodowego, na przyk\u0142ad w zakresie jasno\u015bci zastrze\u017ce\u0144, opisu i rysunk\u00f3w, lub czy zastrze\u017cenia s\u0105 w pe\u0142ni poparte opisem.<\/p>\n

Termin na z\u0142o\u017cenie wniosku<\/strong><\/p>\n

Zg\u0142aszaj\u0105cy sk\u0142ada wniosek do w\u0142a\u015bciwego Mi\u0119dzynarodowego Organu Bada\u0144 Wst\u0119pnych przed up\u0142ywem p\u00f3\u017aniejszego z nast\u0119puj\u0105cych termin\u00f3w:<\/p>\n

1.<\/strong> trzech miesi\u0119cy od daty przekazania zg\u0142aszaj\u0105cemu sprawozdania z mi\u0119dzynarodowego poszukiwania i pisemnej opinii okre\u015blonej na podstawie zasady 43bis.1, lub deklaracji o kt\u00f3rej mowa w artykule 17(2)(a); lub<\/p>\n

2.<\/strong> 22 miesi\u0119cy od daty pierwsze\u0144stwa zg\u0142oszenia mi\u0119dzynarodowego.<\/p>\n

Odno\u015bne op\u0142aty, tj. op\u0142at\u0119 manipulacyjn\u0105 oraz op\u0142at\u0119 za badanie wst\u0119pne, uiszcza si\u0119 jednocze\u015bnie ze z\u0142o\u017ceniem wniosku do IPEA.<\/p>\n

Terminy i dor\u0119czenia<\/strong><\/p>\n

Wyszehradzki Instytut Patentowy wydaje mi\u0119dzynarodowe sprawozdanie wst\u0119pne na temat zdolno\u015bci patentowej w ci\u0105gu co najmniej 28 miesi\u0119cy od daty pierwsze\u0144stwa, chyba \u017ce ma miejsce<\/p>\n

\u2022 sp\u00f3\u017anione z\u0142o\u017cenie wymaganych dokument\u00f3w (wniosku, zmian, itp)<\/p>\n

\u2022 niedotrzymanie termin\u00f3w obowi\u0105zuj\u0105cych wnioski do IPEA (brak lub op\u00f3\u017anienia z\u00a0dokonaniem op\u0142at, op\u00f3\u017anienie w\u00a0dostarczeniu t\u0142umacze\u0144, korekty oczywistych omy\u0142ek, itd.)<\/p>\n

I<\/strong>nternational Search<\/h2>\n

The international search (IS) is carried out by an International Searching Authority (ISA) concerning an international patent application which is filed with a Receiving Office (RO), in order to find the most relevant prior art documents regarding the claimed subject matter in the application.<\/p>\n

The objective of the international search is to discover prior art which is relevant for the purpose of determining whether, and if so, to what extent, the claimed invention to which the international application relates is or is not novel and does or does not involve an inventive step. Based on the above, the International Searching Authority (ISA) establishes either an International Search Report (ISR) or a Declaration of non-establishment of ISR.<\/p>\n

I<\/strong>nternational P<\/strong>reliminary E<\/strong>xamination (IPE)<\/h2>\n

The international preliminary examination (often referred to as \u201cChapter II\u201d) is an optional part of the processing of an international patent application.<\/p>\n

The aim of the international preliminary examination is not to grant or refuse a patent, but to obtain a preliminary and non-binding opinion as to whether the claimed invention appears to be novel, to involve an inventive step and to be industrially applicable.<\/p>\n

S<\/strong>upplementary I<\/strong>nternational S<\/strong>earch (SIS)<\/h2>\n

The supplementary international search service offers applicants the choice to request additional searches from ISAs other than the one that carried out the initial PCT search. This service gives applicants the option of obtaining a more complete overview of the prior art in the international phase by allowing them to have an additional search performed in an ISA\u2019s specialty language.
