Us\u0142uga dodatkowego poszukiwania mi\u0119dzynarodowego daje zg\u0142aszaj\u0105cym mo\u017cliwo\u015b\u0107 zwr\u00f3cenia si\u0119 do ISA o dodatkowe poszukiwanie<\/strong>, inne od tego, kt\u00f3re jest wykonywane w ramach wst\u0119pnego poszukiwania PCT. Us\u0142uga ta daje zg\u0142aszaj\u0105cym mo\u017cliwo\u015b\u0107 uzyskania pe\u0142niejszego obrazu stanu techniki<\/strong> w fazie mi\u0119dzynarodowej poprzez dodatkowe poszukiwanie przeprowadzone w j\u0119zyku specjalistycznym ISA. Wyszehradzki Instytut Patentowy jest jednym z organ\u00f3w ISA, kt\u00f3re oferuj\u0105 dodatkowe poszukiwania mi\u0119dzynarodowe.<\/p>\n

Poszukiwanie<\/strong><\/p>\n

Dodatkowe poszukiwanie mi\u0119dzynarodowe, poza minimum dokumentacji PCT, obejmuje przynajmniej dokumenty w j\u0119zykach czeskim, w\u0119gierskim, polskim i s\u0142owackim<\/strong> b\u0119d\u0105ce w posiadaniu WIP.<\/p>\n

Proces i termin dostarczenia<\/strong><\/p>\n

Zg\u0142aszaj\u0105cy mog\u0105 wnioskowa\u0107 o sprawozdanie z\u00a0dodatkowego poszukiwania mi\u0119dzynarodowego sporz\u0105dzonego przez ISA w terminie do 19 miesi\u0119cy od daty zg\u0142oszenia (pierwsze\u0144stwa). Dodatkowe poszukiwanie mi\u0119dzynarodowe przeprowadza si\u0119 w odniesieniu do zg\u0142oszenia PCT tak jak zosta\u0142o wniesione.<\/p>\n

\u2022 Organ Dodatkowego Poszukiwania (SISA) rozpoczyna dodatkowe poszukiwanie najp\u00f3\u017aniej przed up\u0142ywem 22 miesi\u0119cy od daty pierwsze\u0144stwa,<\/p>\n

I<\/strong>nternational Search<\/h2>\n

The international search (IS) is carried out by an International Searching Authority (ISA) concerning an international patent application which is filed with a Receiving Office (RO), in order to find the most relevant prior art documents regarding the claimed subject matter in the application.<\/p>\n

The objective of the international search is to discover prior art which is relevant for the purpose of determining whether, and if so, to what extent, the claimed invention to which the international application relates is or is not novel and does or does not involve an inventive step. Based on the above, the International Searching Authority (ISA) establishes either an International Search Report (ISR) or a Declaration of non-establishment of ISR.<\/p>\n

I<\/strong>nternational P<\/strong>reliminary E<\/strong>xamination (IPE)<\/h2>\n

The international preliminary examination (often referred to as \u201cChapter II\u201d) is an optional part of the processing of an international patent application.<\/p>\n

The aim of the international preliminary examination is not to grant or refuse a patent, but to obtain a preliminary and non-binding opinion as to whether the claimed invention appears to be novel, to involve an inventive step and to be industrially applicable.<\/p>\n

S<\/strong>upplementary I<\/strong>nternational S<\/strong>earch (SIS)<\/h2>\n

The supplementary international search service offers applicants the choice to request additional searches from ISAs other than the one that carried out the initial PCT search. This service gives applicants the option of obtaining a more complete overview of the prior art in the international phase by allowing them to have an additional search performed in an ISA\u2019s specialty language.
