V r\u00e1mci pokra\u010duj\u00faceho \u00fasilia o roz\u0161irovanie siete v susedn\u00fdch krajin\u00e1ch podp\u00edsal Vy\u0161ehradsk\u00fd patentov\u00fd in\u0161tit\u00fat (VPI) 10. marca 2026 v Z\u00e1hrebe memorandum o porozumen\u00ed s \u00daradom priemyseln\u00e9ho vlastn\u00edctva Chorv\u00e1tskej republiky (SIPO HR). Dokument podp\u00edsali v mene svojich pr\u00edslu\u0161n\u00fdch organiz\u00e1ci\u00ed gener\u00e1lna riadite\u013eka SIPO HR Ljiljana Kuterovac a riadite\u013eka VPI Johanna Stadler.<\/p>\n

Memorandum o porozumen\u00ed vytv\u00e1ra r\u00e1mec pre spolo\u010dn\u00e9 aktivity zameran\u00e9 na zvy\u0161ovanie povedomia o medzin\u00e1rodnom patentovom syst\u00e9me pod\u013ea Zmluvy o patentovej spolupr\u00e1ci (PCT) a prispieva k \u010fal\u0161iemu posil\u0148ovaniu spolupr\u00e1ce medzi SIPO HR a VPI v z\u00e1ujme inova\u010dn\u00fdch ekosyst\u00e9mov Chorv\u00e1tskej republiky a kraj\u00edn V4.<\/p>\n

Pri pr\u00edle\u017eitosti podpisu memoranda uskuto\u010dnili SIPO HR a VPI kon\u0161trukt\u00edvne rokovanie, na ktorom zhodnotili aktu\u00e1lny v\u00fdvoj a v\u00fdzvy, ale aj presk\u00famali mo\u017enosti, ako lep\u0161ie podporova\u0165 inov\u00e1cie v regi\u00f3ne.<\/p>\n

Na stretnut\u00ed sa z\u00fa\u010dastnil aj predseda Ma\u010farsk\u00e9ho \u00faradu du\u0161evn\u00e9ho vlastn\u00edctva a predseda spr\u00e1vnej rady VPI Szabolcs Farkas, aby podporil \u00fasilie VPI rozv\u00edja\u0165 spolupr\u00e1cu.<\/p>\n

VPI d\u00fafa, \u017ee posiln\u00ed spolupr\u00e1cu so SIPO HR v prospech chorv\u00e1tskych pou\u017e\u00edvate\u013eov a \u010fakuje gener\u00e1lnej riadite\u013eke Ljiljane Kuterovac za jej podporu pri dosahovan\u00ed tohto cie\u013ea.<\/p>\n

Vy\u0161ehradsk\u00fd patentov\u00fd in\u0161tit\u00fat (VPI) a \u00darad Slovinskej republiky pre du\u0161evn\u00e9 vlastn\u00edctvo (SIPO) podp\u00edsali v novembri 2023 memorandum o porozumen\u00ed s cie\u013eom vytvori\u0165 r\u00e1mec spolupr\u00e1ce medzi oboma organiz\u00e1ciami. Cie\u013eom memoranda bolo podpori\u0165 n\u00e1rodn\u00e9 a medzin\u00e1rodn\u00e9 patentov\u00e9 aktivity slovinsk\u00fdch prihlasovate\u013eov a spolo\u010dne zvy\u0161ova\u0165 povedomie o patentovan\u00ed v r\u00e1mci medzin\u00e1rodn\u00e9ho patentov\u00e9ho syst\u00e9mu a o komer\u010dn\u00fdch patentov\u00fdch re\u0161er\u0161n\u00fdch slu\u017eb\u00e1ch VPI.<\/p>\n

Spolupr\u00e1ca oboch organiz\u00e1ci\u00ed dosiahla \u010fal\u0161iu f\u00e1zu, ke\u010f pani Karin \u017dvokelj (riadite\u013eka SIPO) a pani Johanna Stadler (riadite\u013eka VPI) podp\u00edsali 3. marca 2026 v Budape\u0161ti dohodu o re\u0161er\u0161nej spolupr\u00e1ci medzi svojimi in\u0161tit\u00faciami.<\/p>\n

T\u00e1to dohoda spr\u00edstup\u0148uje re\u0161er\u0161n\u00fa slu\u017ebu VPI slovinsk\u00fdm prihlasovate\u013eom po\u010das n\u00e1rodn\u00e9ho patentov\u00e9ho konania, \u010d\u00edm im poskytuje viac mo\u017enost\u00ed na z\u00edskanie inform\u00e1ci\u00ed o patentovate\u013enosti ich vyn\u00e1lezu.<\/p>\n

VPI s pote\u0161en\u00edm poskytuje SIPO a slovinsk\u00fdm prihlasovate\u013eom svoju patentov\u00fa re\u0161er\u0161n\u00fa slu\u017ebu, ktor\u00e1 obsahuje p\u00edsomn\u00e9 stanovisko k patentovate\u013enosti vypracovan\u00e9 v s\u00falade so \u0161tandardmi PCT.<\/p>\n

33. zasadnutie V\u00fdboru pre technick\u00fa spolupr\u00e1cu (CTC) Zmluvy o patentovej spolupr\u00e1ci (PCT) sa konalo v s\u00eddle Svetovej organiz\u00e1cie du\u0161evn\u00e9ho vlastn\u00edctva (WIPO) v \u017deneve v d\u0148och 2.-3. febru\u00e1ra 2026 pod predsedn\u00edctvom prof. Unnata P. Pandita (India). <\/p>\n

Najv\u00fdznamnej\u0161\u00edm bodom programu t\u00fdkaj\u00facim sa org\u00e1nov PCT bolo predl\u017eenie vymenovania za org\u00e1n pre medzin\u00e1rodn\u00fa re\u0161er\u0161 (ISA) a org\u00e1n pre medzin\u00e1rodn\u00fd predbe\u017en\u00fd prieskum (IPEA) na obdobie 10 rokov od 1. janu\u00e1ra 2028. Z\u00e1stupcovia org\u00e1nov PCT predlo\u017eili s\u00fahrn svojej pr\u00e1ce za uplynul\u00e9 desa\u0165ro\u010die a od\u00f4vodnenie svojej \u017eiadosti o obnovenie \u0161tat\u00fatu org\u00e1nu PCT.<\/p>\n

Pani Johanna Stadler, riadite\u013eka VPI, zastupovala VPI na zasadnut\u00ed CTC. Na z\u00e1klade hodnotenia CTC z\u00edskal VPI priazniv\u00e9 stanovisko, \u010do znamen\u00e1, \u017ee Zhroma\u017edenie \u00danie PCT bolo po\u017eiadan\u00e9, aby schv\u00e1lilo pred\u013a\u017eenie poverenia VPI ako medzin\u00e1rodn\u00e9ho re\u0161er\u0161n\u00e9ho org\u00e1nu a org\u00e1nu medzin\u00e1rodn\u00e9ho predbe\u017en\u00e9ho prieskumu na \u010fal\u0161\u00edch 10 rokov, po\u010dn\u00fac 1. janu\u00e1rom 2028.<\/p>\n

V r\u00e1mci portf\u00f3lia Glob\u00e1lnych Patentov\u00fdch Re\u0161er\u0161n\u00fdch Slu\u017eieb (GPSS) sp\u00fa\u0161\u0165a Vy\u0161ehradsk\u00fd patentov\u00fd in\u0161tit\u00fat (VPI) nov\u00fa re\u0161er\u0161n\u00fa slu\u017ebu d\u0148a 1. okt\u00f3bra 2025. Rovnako ako \u010fal\u0161ie dve slu\u017eby GPSS, aj slu\u017eba Preverenie patentu (VSS) je dostupn\u00e1 komuko\u013evek na svete bez oh\u013eadu na \u0161t\u00e1tnu pr\u00edslu\u0161nos\u0165.<\/p>\n

Slu\u017eba VSS poskytuje inform\u00e1cie o skor\u0161om stave techniky vo vz\u0165ahu k ur\u010dit\u00e9mu platn\u00e9mu patentu v priebehu len 4 t\u00fd\u017ed\u0148ov. Identifikuje patentov\u00e9 dokumenty a publik\u00e1cie, ktor\u00e9 m\u00f4\u017eu by\u0165 zoh\u013eadnen\u00e9 pri posudzovan\u00ed novosti a vyn\u00e1lezcovskej \u010dinnosti vo vz\u0165ahu k tomuto patentu.<\/p>\n

Inform\u00e1cie z\u00edskan\u00e9 z VSS m\u00f4\u017eu by\u0165 u\u017eito\u010dn\u00e9 napr\u00edklad pri podan\u00ed n\u00e1mietok\/presk\u00faman\u00ed patentu po udelen\u00ed, pri s\u00fadnom spore alebo na posilnenie n\u00e1rokov pri poru\u0161en\u00ed pr\u00e1v. Podrobn\u00e1 patentov\u00e1 re\u0161er\u0161 m\u00f4\u017ee tie\u017e chr\u00e1ni\u0165 invest\u00edcie pred pl\u00e1novan\u00fdmi transakciami t\u00fdkaj\u00facimi sa dan\u00e9ho patentu.<\/p>\n

Vy\u0161ehradsk\u00fd patentov\u00fd in\u0161tit\u00fat (VPI) od 7. j\u00fala 2025 uplat\u0148uje zv\u00fdhodnen\u00fa cenu 650 eur za slu\u017ebu re\u0161er\u0161 na novos\u0165 (NSS) ako s\u00fa\u010das\u0165 dlhodob\u00e9ho \u00fasilia o zvy\u0161ovanie dostupnosti slu\u017eieb.<\/p>\n

Slu\u017eba NSS je s\u00fa\u010das\u0165ou glob\u00e1lnych patentov\u00fdch re\u0161er\u0161n\u00fdch slu\u017eieb (GPSS), poskytuje klientom inform\u00e1cie o stave techniky pre dan\u00fd vyn\u00e1lez\/technick\u00e9 rie\u0161enie a identifikuje patentov\u00e9 dokumenty a in\u00e9 publik\u00e1cie, ktor\u00e9 sa m\u00f4\u017eu zoh\u013eadni\u0165 pri posudzovan\u00ed podmienky novosti a vyn\u00e1lezcovskej \u010dinnosti vo vz\u0165ahu k op\u00edsan\u00e9mu vyn\u00e1lezu. V\u00fdsledkom je re\u0161er\u0161 vypracovan\u00e1 v priebehu \u0161tyroch t\u00fd\u017ed\u0148ov, ktor\u00e1 pom\u00e1ha potenci\u00e1lnym \u017eiadate\u013eom o patent alebo PCT prija\u0165 informovan\u00e9 rozhodnutia predt\u00fdm, ako sa zavia\u017eu k finan\u010dn\u00fdm a pr\u00e1vnym povinnostiam, ktor\u00e9 vypl\u00fdvaj\u00fa z form\u00e1lnej patentovej prihl\u00e1\u0161ky.<\/p>\n

Okrem NSS pon\u00faka VPI aj slu\u017ebu s roz\u0161\u00edren\u00fdm rozsahom \u2013 re\u0161er\u0161 na novos\u0165 s predbe\u017enou spr\u00e1vou o patentovate\u013enosti (NSPPR), ktor\u00e1 poskytuje nielen re\u0161er\u0161n\u00fa slu\u017ebu, ale aj odborn\u00e9 a od\u00f4vodnen\u00e9 stanovisko k ot\u00e1zke, \u010di technick\u00e9 rie\u0161enie sp\u013a\u0148a tri z\u00e1kladn\u00e9 krit\u00e9ri\u00e1 patentovate\u013enosti: novos\u0165, vyn\u00e1lezcovsk\u00fa \u010dinnos\u0165 a priemyseln\u00fa vyu\u017eite\u013enos\u0165.<\/p>\n

Tento dokument, podp\u00edsan\u00fd prezidentom APO Stefanom Harasekom a riadite\u013ekou VPI Johannou Stadlerovou, vytv\u00e1ra r\u00e1mec pre spolupr\u00e1cu medzi t\u00fdmito dvoma organiz\u00e1ciami s cie\u013eom podpori\u0165 hospod\u00e1rsku a technologick\u00fa v\u00fdmenu a zv\u00fd\u0161i\u0165 povedomie o mierovej technickej spolupr\u00e1ci v strednej Eur\u00f3pe.<\/p>\n

Toto MoU s APO m\u00e1 pre VPI osobitn\u00fd v\u00fdznam, preto\u017ee pr\u00e1ca APO a jeho z\u00e1kazn\u00edcky priate\u013esk\u00e9 postupy sl\u00fa\u017eia pre VPI ako vzor. MoU stavia na silnom existuj\u00facom vz\u0165ahu medzi t\u00fdmito dvoma organiz\u00e1ciami a otv\u00e1ra pre VPI nov\u00e9 mo\u017enosti roz\u0161\u00edrenia svojej siete spolupr\u00e1ce v r\u00e1mci strednej Eur\u00f3py.<\/p>\n

Dnes si pripom\u00edname 10. v\u00fdro\u010die d\u0148a, ke\u010f sa \u0161tyri krajiny strednej a v\u00fdchodnej Eur\u00f3py \u2013 \u010cesk\u00e1 republika, Ma\u010farsko, Po\u013esko a Slovensko \u2013 rozhodli spoji\u0165 zdroje svojich n\u00e1rodn\u00fdch \u00faradov priemyseln\u00e9ho vlastn\u00edctva a ich z\u00e1stupcovia podp\u00edsali Dohodu o Vy\u0161ehradskom patentovom in\u0161tit\u00fate. T\u00e1to v\u00fdznamn\u00e1 udalos\u0165 bola v\u00fdsledkom s\u00e9rie \u00faspe\u0161n\u00fdch rokovan\u00ed, ktor\u00e9 n\u00e1m umo\u017enili vyda\u0165 sa na skuto\u010dne vzru\u0161uj\u00facu cestu.<\/p>\n

Na z\u00e1klade dohody podp\u00edsanej 26. febru\u00e1ra 2015 a po rozhodnut\u00ed Zhroma\u017edenia PCT pri WIPO za\u010dal VPI svoju \u010dinnos\u0165 1. j\u00fala 2016 s cie\u013eom podporova\u0165 inov\u00e1cie a kreativitu a prispieva\u0165 k hospod\u00e1rskemu rastu a konkurencieschopnosti v regi\u00f3ne strednej a v\u00fdchodnej Eur\u00f3py. V nasleduj\u00facich rokoch boli podp\u00edsan\u00e9 Memorand\u00e1 o porozumen\u00ed s Litvou, Srbskom a Slovinskom, v\u010faka \u010domu m\u00f4\u017eu slu\u017eby VPI vyu\u017e\u00edva\u0165 aj obyvatelia t\u00fdchto kraj\u00edn.<\/p>\n

Po\u010das desa\u0165ro\u010dia od podp\u00edsania Dohody sa VPI usiloval sta\u0165 sa \u201ePCT autoritou na dosah\u201c v regi\u00f3ne, poskytuj\u00fac svojim u\u017e\u00edvate\u013eom \u0161pi\u010dkov\u00e9 slu\u017eby a mo\u017enos\u0165 spravova\u0165 svoje prihl\u00e1\u0161ky PCT vo svojom rodnom jazyku, \u010d\u00edm zvy\u0161uje ich \u0161ance na \u00faspe\u0161n\u00e9 z\u00edskanie patentu na celosvetovej \u00farovni.<\/p>\n

Chceli by sme po\u010fakova\u0165 v\u0161etk\u00fdm, ktor\u00ed prispeli k vzniku Vy\u0161ehradsk\u00e9ho patentov\u00e9ho in\u0161tit\u00fatu. Sme v\u010fa\u010dn\u00ed v\u0161etk\u00fdm v\u00fdznamn\u00fdm ved\u00facim pracovn\u00edkom pobo\u010diek VPI a \u010fal\u0161\u00edm medzin\u00e1rodn\u00fdm partnersk\u00fdm organiz\u00e1ci\u00e1m, minul\u00fdm aj s\u00fa\u010dasn\u00fdm, ktor\u00ed podporili zalo\u017eenie na\u0161ej region\u00e1lnej PCT autority a ktor\u00ed sa odvtedy podie\u013eaj\u00fa na jej ka\u017edodennej prev\u00e1dzke. Predov\u0161etk\u00fdm sme v\u0161ak v\u010fa\u010dn\u00ed v\u0161etk\u00fdm inovat\u00edvnym a kreat\u00edvnym myslite\u013eom, ktor\u00ed zverili osud svojich vyn\u00e1lezov do odborn\u00fdch r\u00fak na\u0161ich kolegov.<\/p>\n

Sprievodca vych\u00e1dza zo spr\u00e1vy \u201eFinan\u010dn\u00e9 stimuly ako n\u00e1stroj na zlep\u0161enie inova\u010dn\u00e9ho ekosyst\u00e9mu V4 a zv\u00fd\u0161enie ochrany du\u0161evn\u00e9ho vlastn\u00edctva\u201c, ktor\u00fa vypracovalo konzorcium univerz\u00edt V4, Univerzity Karlovej, Pr\u00e1vnickej fakulty z \u010ceskej republiky, Debrec\u00ednskej univerzity z Ma\u010farska a Organiz\u00e1cie pre v\u00fdskumn\u00e9 a v\u00fdvojov\u00e9 aktivity zo Slovenska, pod veden\u00edm a koordin\u00e1ciou Jagelovskej univerzity (Krakov) z Po\u013eska v roku 2023.<\/p>\n

P\u00f4vodn\u00fa mapovaciu spr\u00e1vu financoval Medzin\u00e1rodn\u00fd vy\u0161ehradsk\u00fd fond (IVF \u2013 International Visegrad Fund), ktor\u00e9ho poslan\u00edm je podporova\u0165 my\u0161lienky udr\u017eate\u013enej region\u00e1lnej spolupr\u00e1ce v strednej Eur\u00f3pe. IVF je spolufinancovan\u00fd vl\u00e1dami \u010ceskej republiky, Ma\u010farska, Po\u013eska a Slovenska.<\/p>\n

V spr\u00e1ve sa uv\u00e1dza, \u017ee \u010dinnos\u0165 Vy\u0161ehradsk\u00e9ho patentov\u00e9ho in\u0161tit\u00fatu (VPI) podporuje rozvoj inov\u00e1ci\u00ed a konkurencieschopnosti v regi\u00f3ne. Okrem toho spr\u00e1va navrhuje koordinovan\u00e9 region\u00e1lne \u00fasilie o vytvorenie syst\u00e9mov financovania pre miestne MSP, univerzity a v\u00fdskumn\u00e9 \u00fastavy.<\/p>\n

V spr\u00e1ve sa navrhuje doplni\u0165 pr\u00e1cu IVF o region\u00e1lny syst\u00e9m financovania zameran\u00fd na patenty, ktor\u00fd by mohol podporova\u0165 slu\u017eby pon\u00fakan\u00e9 VPI. Mo\u017en\u00e1 sch\u00e9ma na podporu vyu\u017e\u00edvania existuj\u00facich alebo nov\u00fdch slu\u017eieb, ktor\u00e9 VPI pon\u00faka prihlasovate\u013eom z kraj\u00edn V4, by mohla zah\u0155\u0148a\u0165 (i) \u201epoukaz VPI\u201c a (ii) nen\u00e1vratn\u00fd grant vyhraden\u00fd na patentovanie v projektoch financovan\u00fdch IVF. Spr\u00e1va navrhuje, aby bol IVF vymenovan\u00fd za pr\u00edslu\u0161n\u00fd zakladaj\u00faci org\u00e1n.<\/p>\n

Svetov\u00e1 organiz\u00e1cia du\u0161evn\u00e9ho vlastn\u00edctva (WIPO) iniciovala projekt \u201ePCT pre V4\u201c s cie\u013eom zv\u00fd\u0161i\u0165 povedomie o mo\u017enostiach vyu\u017eitia syst\u00e9mu upraven\u00e9ho Zmluvou o patentovej spolupr\u00e1ci (PCT) pri vstupe na medzin\u00e1rodn\u00e9 trhy. Tento projekt, zah\u0155\u0148aj\u00faci semin\u00e1re a r\u00f4zne podujatia v regi\u00f3ne V4, je zameran\u00fd pre inov\u00e1torov z univerz\u00edt, startupov, mal\u00fdch a stredn\u00fdch podnikov.<\/p>\n

Pod\u013ea Vy\u0161ehradsk\u00e9ho patentov\u00e9ho in\u0161tit\u00fatu (VPI) je k\u013e\u00fa\u010dov\u00e9, aby akt\u00e9ri n\u00e1\u0161ho inovat\u00edvneho ekosyst\u00e9mu boli obozn\u00e1men\u00ed s pr\u00edle\u017eitos\u0165ami a v\u00fdhodami, ktor\u00e9 syst\u00e9m PCT pon\u00faka pre \u017eiadate\u013eov o patent, a preto WIPO \u010fakujeme za iniciat\u00edvu a mo\u017enos\u0165 podie\u013ea\u0165 sa na projekte \u201ePCT pre V4.\u201c <\/p>\n

Prv\u00fdm miestom s\u00e9rie podujat\u00ed v r\u00e1mci projektu “PCT for V4” bola \u010cesk\u00e1 republika, kde WIPO v spolupr\u00e1ci s \u00daradom priemyseln\u00e9ho vlastn\u00edctva \u010ceskej republiky (\u00daPV \u010cR) a Vy\u0161ehradsk\u00fdm patentov\u00fdm in\u0161tit\u00fatom zorganizovala semin\u00e1r PCT pre inov\u00e1torov z univerz\u00edt, startupov a mal\u00fdch a stredn\u00fdch podnikov z Prahy. V roku 2023 bol Vy\u0161ehradsk\u00fd patentov\u00fd in\u0161tit\u00fat celosvetovo najr\u00fdchlej\u0161\u00edm org\u00e1nom na svete vo v\u010dasnosti vyhotovenia a zasielania spr\u00e1v o medzin\u00e1rodnej re\u0161er\u0161i Medzin\u00e1rodn\u00e9mu \u00faradu WIPO, meran\u00e9 od d\u00e1tumu priority (dodacia lehota dev\u00e4\u0165 mesiacov), ako aj od d\u00e1tumu prijatia re\u0161er\u0161nej k\u00f3pie (dodacia lehota tri mesiace) pod\u013ea ro\u010dn\u00e9ho prieskumu PCT, ktor\u00fd zverejnila Svetov\u00e1 organiz\u00e1cia du\u0161evn\u00e9ho vlastn\u00edctva v roku 2024<\/span><\/a>.<\/p>\n

VPI sa v r\u00e1mci slu\u017eieb z\u00e1kazn\u00edkom neust\u00e1le sna\u017e\u00ed skr\u00e1ti\u0165 lehoty spracovania spr\u00e1v o medzin\u00e1rodnej re\u0161er\u0161i. Od 1. janu\u00e1ra 2023 boli zaveden\u00e9 krat\u0161ie intern\u00e9 dodacie lehoty a \u0161tatistiky WIPO potvrdzuj\u00fa, \u017ee t\u00e1to iniciat\u00edva VPI priniesla u\u017e\u00edvate\u013eom priazniv\u00e9 v\u00fdsledky. Pr\u00edsne normy kvality ISO VPI zaru\u010duj\u00fa, \u017ee slu\u017eby s\u00fa poskytovan\u00e9 nielen r\u00fdchlo, ale aj vo vynikaj\u00facej kvalite.<\/p>\n

Na z\u00e1klade sp\u00e4tnej v\u00e4zby klientov sme na webovej str\u00e1nke Vy\u0161ehradsk\u00e9ho patentov\u00e9ho in\u0161tit\u00fatu vytvorili sekciu poplatky a refund\u00e1cie, kde n\u00e1jdete na jednom mieste online formul\u00e1r \u017eiadosti o vr\u00e1tenie poplatku za re\u0161er\u0161 spolu s \u010fal\u0161\u00edmi inform\u00e1ciami o poplatkoch a refund\u00e1ci\u00e1ch.<\/p>\n

Sekretari\u00e1t VPI v roku 2023 uskuto\u010dnil prieskum s cie\u013eom lep\u0161ie pochopi\u0165 o\u010dak\u00e1vania pou\u017e\u00edvate\u013eov a podnikol aj vhodn\u00e9 u\u017e\u00edvate\u013esky pr\u00edvetiv\u00e9 kroky. Patentov\u00ed z\u00e1stupcovia, ktor\u00ed akt\u00edvne vyu\u017e\u00edvaj\u00fa VPI, boli po\u017eiadan\u00ed o sp\u00e4tn\u00fa v\u00e4zbu, pokia\u013e ide o kvalitu, r\u00fdchlos\u0165 a celkov\u00fa spokojnos\u0165 so slu\u017ebami VPI. Osloven\u00ed boli aj odborn\u00edci, aby sa podelili o n\u00e1pady na nov\u00e9 slu\u017eby, ktor\u00e9 by mohli pova\u017eova\u0165 za prospe\u0161n\u00e9. <\/p>\n

Z odpoved\u00ed vypl\u00fdva, \u017ee respondenti najviac oce\u0148uj\u00fa r\u00fdchlos\u0165 pon\u00fakan\u00fdch slu\u017eieb, n\u00e1kladov\u00fa efekt\u00edvnos\u0165, ako aj u\u017e\u00edvate\u013esky pr\u00edvetiv\u00fa administrat\u00edvu a mo\u017enos\u0165 pou\u017e\u00edva\u0165 n\u00e1rodn\u00fd jazyk po\u010das medzin\u00e1rodnej f\u00e1zy konania PCT. <\/p>\n

Respondenti navrhli aj zjednodu\u0161i\u0165 sp\u00f4sob pod\u00e1vania \u017eiadost\u00ed o vr\u00e1tenie poplatku za re\u0161er\u0161. Z toho d\u00f4vodu VPI vytvoril na webovej str\u00e1nke nov\u00fa sekciu poplatky a refund\u00e1cie s online formul\u00e1rom \u017eiadosti o vr\u00e1tenie poplatku za re\u0161er\u0161. Formul\u00e1r pom\u00f4\u017ee ur\u00fdchli\u0165 proces vr\u00e1tenia pod\u013ea okolnost\u00ed 40 % alebo 50 % z poplatku za medzin\u00e1rodn\u00fa re\u0161er\u0161, ak VPI vyu\u017eije skor\u0161iu spr\u00e1vu o re\u0161er\u0161i po\u010das medzin\u00e1rodnej re\u0161er\u0161e. <\/p>\n

Okrem dostupn\u00fdch mo\u017enost\u00ed podania \u017eiadosti, napr\u00edklad e-mailom alebo prostredn\u00edctvom elektronick\u00e9ho syst\u00e9mu ePCT, je online formul\u00e1r \u017eiadosti o vr\u00e1tenie poplatku za re\u0161er\u0161 \u010fal\u0161\u00edm elektronick\u00fdm sp\u00f4sobom. Prim\u00e1rnym cie\u013eom spustenia slu\u017eieb bolo spr\u00edstupni\u0165 inform\u00e1cie o stave techniky ve\u013emi r\u00fdchlo a za rozumn\u00fa cenu pau\u0161\u00e1lneho poplatku e\u0161te pred podan\u00edm patentovej prihl\u00e1\u0161ky.<\/p>\n

Spusten\u00edm Fondu pre MSP m\u00f4\u017eu v roku 2024 mal\u00e9 a stredn\u00e9 podniky so s\u00eddlom v E\u00da vyu\u017e\u00edva\u0165 tieto slu\u017eby, a tak zn\u00ed\u017ei\u0165 n\u00e1klady o 75 %. <\/p>\n

Fond EUIPO pre MSP \u201eIdeas Powered for Business\u201d je grantov\u00e1 sch\u00e9ma ur\u010den\u00e1 na pomoc mal\u00fdm a stredn\u00fdm podnikom so s\u00eddlom v E\u00da s cie\u013eom chr\u00e1ni\u0165 ich pr\u00e1va du\u0161evn\u00e9ho vlastn\u00edctva. Grant z Fondu pre MSP okrem in\u00e9ho prepl\u00e1ca n\u00e1klady na re\u0161er\u0161e, patentov\u00e9 prihl\u00e1\u0161ky alebo dokonca slu\u017eby patentov\u00e9ho z\u00e1stupcu. Na pomoc inovat\u00edvnym MSP, vysoko\u0161kolsk\u00fdm in\u0161tit\u00faci\u00e1m, v\u00fdskumn\u00fdm organiz\u00e1ci\u00e1m a individu\u00e1lnym vyn\u00e1lezcom VPI roz\u0161\u00edril portf\u00f3lio slu\u017eieb, aby mohol lep\u0161ie sl\u00fa\u017ei\u0165 prihlasovate\u013eom a \u010do najr\u00fdchlej\u0161ie poskytn\u00fa\u0165 cenn\u00e9 inform\u00e1cie o novosti a patentovate\u013enosti ich technick\u00fdch vyn\u00e1lezov alebo rie\u0161en\u00ed.<\/p>\n

Dve nov\u00e9 slu\u017eby, re\u0161er\u0161 na novos\u0165 a re\u0161er\u0161 na novos\u0165 s predbe\u017enou spr\u00e1vou o patentovate\u013enosti, sa spustia pod n\u00e1zvom glob\u00e1lne patentov\u00e9 re\u0161er\u0161n\u00e9 slu\u017eby a daj\u00fa odborn\u00edkom odpovede na ot\u00e1zky novosti a patentovate\u013enosti vyn\u00e1lezu alebo technick\u00e9ho rie\u0161enia u\u017e do \u0161tyroch t\u00fd\u017ed\u0148ov. Re\u0161er\u0161e vykon\u00e1vaj\u00fa patentov\u00ed experti, so sk\u00fasenos\u0165ami s PCT postupmi, s pou\u017eit\u00edm rovnak\u00fdch datab\u00e1z ako pri pr\u00e1ci PCT autority.<\/p>\n

Prim\u00e1rnym poslan\u00edm Vy\u0161ehradsk\u00e9ho patentov\u00e9ho in\u0161tit\u00fatu (VPI) je pom\u00e1ha\u0165 \u201emiestnym\u201c inovat\u00edvnym podnikom, univerzit\u00e1m, v\u00fdskumn\u00fdm in\u0161tit\u00faci\u00e1m a individu\u00e1lnym vyn\u00e1lezcom z\u00edska\u0165 patentov\u00fa ochranu v zahrani\u010d\u00ed a bezpe\u010dne vst\u00fapi\u0165 na medzin\u00e1rodn\u00fd trh.<\/p>\n

Spr\u00e1vna rada VPI na svojom 18. zasadnut\u00ed rozhodla o spusten\u00ed nov\u00fdch re\u0161er\u0161n\u00fdch slu\u017eieb s cie\u013eom podpori\u0165 patentov\u00e9 \u00fasilie prihlasovate\u013eov a potenci\u00e1lnych prihlasovate\u013eov t\u00fdm, \u017ee im poskytne inform\u00e1cie o novosti a vyhliadkach patentovate\u013enosti ich vyn\u00e1lezu v ranom \u0161t\u00e1diu bez finan\u010dn\u00e9ho z\u00e1v\u00e4zku patentovej prihl\u00e1\u0161ky.<\/p>\n

VPI spust\u00ed od 1. okt\u00f3bra 2023 v\u00fdkon dvoch typov komer\u010dn\u00fdch re\u0161er\u0161n\u00fdch slu\u017eieb: vykon\u00e1vania re\u0161er\u0161e na novos\u0165 a re\u0161er\u0161e na novos\u0165 s predbe\u017enou spr\u00e1vou o patentovate\u013enosti.<\/p>\n

Svetov\u00e1 organiz\u00e1cia du\u0161evn\u00e9ho vlastn\u00edctva (WIPO) spustila komplexn\u00fd proces pos\u00fadenia u\u017eito\u010dnosti re\u0161er\u0161n\u00fdch strat\u00e9gi\u00ed, ktor\u00e9 boli vypracovan\u00e9 org\u00e1nmi PCT po\u010das medzin\u00e1rodnej re\u0161er\u0161e. Celosvetovo WIPO spustila dva r\u00f4zne prieskumy, jeden pre u\u017e\u00edvate\u013eov a druh\u00fd pre org\u00e1ny PCT. Inform\u00e1cie a \u010fal\u0161ie n\u00e1vrhy z\u00edskan\u00e9 z prieskumu bud\u00fa vyhodnoten\u00e9 na \u00fa\u010dely \u010fal\u0161ieho rozvoja s\u00fa\u010dasnej podoby re\u0161er\u0161nej strat\u00e9gie.<\/p>\n

Vy\u0161ehradsk\u00fd patentov\u00fd in\u0161tit\u00fat vyz\u00fdva svojich u\u017e\u00edvate\u013eov, aby sa zapojili do prieskumu WIPO. V\u00fdsledky anonymn\u00e9ho prieskumu bud\u00fa vyhodnoten\u00e9 org\u00e1nmi PCT, aby poskytli preh\u013ead n\u00e1vrhov re\u0161er\u0161n\u00fdch strat\u00e9gi\u00ed.<\/p>\n

Vy\u0161ehradsk\u00fd patentov\u00fd in\u0161tit\u00fat sl\u00fa\u017ei svojim prihlasovate\u013eom t\u00fdm, \u017ee im zabezpe\u010duje v\u010dasn\u00fd pr\u00edstup k medzin\u00e1rodn\u00fdm re\u0161er\u0161n\u00fdm spr\u00e1vam, ktor\u00e9 im pom\u00e1haj\u00fa lep\u0161ie vyhodnoti\u0165 ich patentov\u00e9 \u0161ance na \u00fazem\u00ed relevantn\u00fdch trhov.<\/p>\n

Prv\u00fdm krokom bolo od 1. j\u00fana 2021 skr\u00e1tenie lehoty na vyhotovenie ISR z 3-mesa\u010dnej alebo 9-mesa\u010dnej, ako to stanovuje PCT, o jeden t\u00fd\u017ede\u0148. V\u010faka tejto iniciat\u00edve a pod\u013ea \u00fadajov WIPO sa Vy\u0161ehradsk\u00fd patentov\u00fd in\u0161tit\u00fat stal v roku 2021 najr\u00fdchlej\u0161ou autoritou PCT na svete vo vyd\u00e1van\u00ed medzin\u00e1rodn\u00fdch re\u0161er\u0161n\u00fdch spr\u00e1v a p\u00edsomn\u00fdch stanov\u00edsk.<\/p>\n

Sk\u00fasenosti z\u00edskan\u00e9 s ur\u00fdchlen\u00edm vypracovania medzin\u00e1rodn\u00fdch re\u0161er\u0161n\u00fdch spr\u00e1v umo\u017enia v roku 2023 \u010falej skr\u00e1ti\u0165 dodaciu lehotu ISR bez toho, aby do\u0161lo k ak\u00e9muko\u013evek kompromisu v kvalite medzin\u00e1rodn\u00fdch re\u0161er\u0161n\u00fdch spr\u00e1v.<\/p>\n

V pr\u00edpade, kedy nie je uplatnen\u00e1 priorita pre medzin\u00e1rodn\u00e9 prihl\u00e1\u0161ky podan\u00e9 od 1. janu\u00e1ra 2023, sa lehota na vydanie ISR skracuje na 8 mesiacov. Vo v\u0161etk\u00fdch ostatn\u00fdch pr\u00edpadoch Vy\u0161ehradsk\u00fd patentov\u00fd in\u0161tit\u00fat zachov\u00e1va doteraj\u0161iu prax, teda o jeden t\u00fd\u017ede\u0148 krat\u0161iu dodaciu lehotu.<\/p>\n

Cie\u013eom MoU je zintenz\u00edvni\u0165 spolo\u010dn\u00e9 \u00fasilie na zv\u00fd\u0161enie povedomia o patentovan\u00ed a najm\u00e4 o medzin\u00e1rodnom patentovom syst\u00e9me. MVF a VPI pl\u00e1nuj\u00fa organizova\u0165 v\u00fdmenu expertov a konzult\u00e1cie a spusti\u0165 r\u00f4zne nov\u00e9 iniciat\u00edvy a granty najm\u00e4 pre vyn\u00e1lezcov a region\u00e1lne mal\u00e9 a stredn\u00e9 podniky.<\/p>\n

VPI je pevne odhodlan\u00fd podporova\u0165 u\u017e\u0161iu spolupr\u00e1cu medzi ob\u010danmi a inovat\u00edvnymi podnikmi, v\u00fdskumn\u00fdmi \u00fastavmi a univerzitami kraj\u00edn V4 s cie\u013eom u\u013eah\u010di\u0165 spolo\u010dn\u00e9 vytv\u00e1ranie a vyu\u017e\u00edvanie vyn\u00e1lezov. V memorande o porozumen\u00ed \u00darad du\u0161evn\u00e9ho vlastn\u00edctva Srbskej republiky vyhlasuje, \u017ee VPI je kvalifikovan\u00fdm org\u00e1nom pre medzin\u00e1rodn\u00fa re\u0161er\u0161 (ISA) a org\u00e1nom pre medzin\u00e1rodn\u00fd predbe\u017en\u00fd prieskum (IPEA) pre medzin\u00e1rodn\u00e9 prihl\u00e1\u0161ky podan\u00e9 pod\u013ea Zmluvy o patentovej spolupr\u00e1ci (PCT) srbsk\u00fdmi \u0161t\u00e1tnymi pr\u00edslu\u0161n\u00edkmi a srbsk\u00fdmi pou\u017e\u00edvate\u013emi.<\/p>\n

Pre VPI je ve\u013ekou c\u0165ou deklarovanie p\u00f4sobenia ISA a IPEA pre srbsk\u00fdch pou\u017e\u00edvate\u013eov. Signat\u00e1ri memoranda o porozumen\u00ed veria, \u017ee t\u00e1to nov\u00e1 mo\u017enos\u0165, ktor\u00e1 je pon\u00faknut\u00e1 srbsk\u00fdm pou\u017e\u00edvate\u013eom, m\u00f4\u017ee prispie\u0165 k rozvoju priemyslu zalo\u017een\u00e9ho na znalostiach a inov\u00e1ci\u00e1ch a mohla by ma\u0165 pozit\u00edvny vplyv na zapojenie sa v\u00fdskumn\u00fdch in\u0161tit\u00faci\u00ed a univerz\u00edt do inova\u010dn\u00e9ho ekosyst\u00e9mu v regi\u00f3ne.
