Na z\u00e1klade uveden\u00e9ho org\u00e1n pre medzin\u00e1rodn\u00fa re\u0161er\u0161 (ISA) vypracuje bu\u010f <strong>spr\u00e1vu o medzin\u00e1rodnej re\u0161er\u0161i<\/strong> (ISR), alebo <strong>vyhl\u00e1senie o nevypracovan\u00ed medzin\u00e1rodnej re\u0161er\u0161e ISR<\/strong>.<\/p>\n<p>S\u00fa\u010dasne s vypracovan\u00edm ISR sa vyprac\u00fava aj <strong>p\u00edsomn\u00e9 stanovisko (WO-ISA), \u010di sa n\u00e1rokovan\u00fd vyn\u00e1lez jav\u00ed ako nov\u00fd, ako zah\u0155\u0148aj\u00faci vyn\u00e1lezcovsk\u00fa \u010dinnos\u0165 a ako priemyselne vyu\u017eite\u013en\u00fd<\/strong> a \u010di sp\u013a\u0148a <strong>\u010fal\u0161ie po\u017eiadavky<\/strong> pod\u013ea PCT, ktor\u00e9 s\u00fa kontrolovan\u00e9 org\u00e1nom pre medzin\u00e1rodn\u00fa re\u0161er\u0161 (ISA).<\/p>\n<p><strong>Konanie<\/strong><\/p>\n<p>Prv\u00fdm krokom konania je podanie medzin\u00e1rodnej prihl\u00e1\u0161ky prij\u00edmaciemu \u00faradu (RO). Prihlasovate\u013e mus\u00ed uvies\u0165 vo <strong>formul\u00e1ri PCT\/RO\/101 (Request), ktor\u00fd org\u00e1n pre medzin\u00e1rodn\u00fa re\u0161er\u0161<\/strong> m\u00e1 vykona\u0165 medzin\u00e1rodn\u00fa re\u0161er\u0161 vo vz\u0165ahu k podanej prihl\u00e1\u0161ke. Prihlasovatelia z \u010ceskej republiky, Ma\u010farska, Po\u013eskej republiky a Slovenskej republiky si m\u00f4\u017eu vybra\u0165 Vy\u0161ehradsk\u00fd patentov\u00fd in\u0161tit\u00fat alebo Eur\u00f3psky patentov\u00fd \u00farad. <br \/>Medzin\u00e1rodn\u00e1 re\u0161er\u0161 sa vykon\u00e1va v s\u00falade s usmerneniami pre medzin\u00e1rodn\u00fa re\u0161er\u0161 a medzin\u00e1rodn\u00fd predbe\u017en\u00fd prieskum.<\/p>\n<p><strong>Lehoty a doru\u010denie<\/strong><\/p>\n<p>Vy\u0161ehradsk\u00fd patentov\u00fd in\u0161tit\u00fat vypracuje spr\u00e1vu o medzin\u00e1rodnej re\u0161er\u0161i (ISR) do troch mesiacov od d\u00e1tumu prijatia re\u0161er\u0161nej k\u00f3pie medzin\u00e1rodnej prihl\u00e1\u0161ky alebo do deviatich mesiacov od d\u00e1tumu priority pod\u013ea toho, ktor\u00e1 lehota uplynie nesk\u00f4r, ak:<\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>medzin\u00e1rodn\u00e1 prihl\u00e1\u0161ka neobsahuje viac ako jeden vyn\u00e1lez (a teda prihl\u00e1\u0161ka nesp\u013a\u0148a podmienku jednotnosti),<\/li>\n<li>boli dodr\u017ean\u00e9 lehoty na vykonanie \u00fakonov s\u00favisiacich s v\u00fdzvami RO alebo ISA (zaplatenie poplatkov, preklady, opravy zrejm\u00fdch ch\u00fdb alebo n\u00e1le\u017eitosti t\u00fdkaj\u00face sa zoznamu sekvenci\u00ed a pod.).<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>P\u00edsomn\u00fd posudok (WO) sa vypracuje v lehote vypo\u010d\u00edtanej v s\u00falade s PCT pravidlom 43bis.1.<\/p>\n<p><strong>Poplatky<\/strong><\/p>\n<p>PCT poplatky za podanie medzin\u00e1rodnej prihl\u00e1\u0161ky, t. j. prihlasovac\u00ed poplatok, poplatok za podanie medzin\u00e1rodnej prihl\u00e1\u0161ky PCT, poplatok za medzin\u00e1rodn\u00fa re\u0161er\u0161, <strong>sa platia prij\u00edmaciemu \u00faradu<\/strong> (n\u00e1rodn\u00fdm patentov\u00fdm \u00faradom zmluvn\u00fdch \u0161t\u00e1tov VPI alebo Medzin\u00e1rodn\u00e9mu \u00faradu WIPO).<\/p>\n<p>[\/et_pb_text][\/et_pb_column][\/et_pb_row][\/et_pb_section][et_pb_section fb_built=&#8221;1&#8243; admin_label=&#8221;Services&#8221; _builder_version=&#8221;4.16&#8243; _module_preset=&#8221;default&#8221; custom_padding=&#8221;90px|0px|90px|0px&#8221; global_colors_info=&#8221;{}&#8221; theme_builder_area=&#8221;post_content&#8221;][et_pb_row column_structure=&#8221;1_3,1_3,1_3&#8243; use_custom_gutter=&#8221;on&#8221; make_equal=&#8221;on&#8221; _builder_version=&#8221;4.17.1&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221; theme_builder_area=&#8221;post_content&#8221;][et_pb_column type=&#8221;1_3&#8243; _builder_version=&#8221;4.17.1&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221; theme_builder_area=&#8221;post_content&#8221;][et_pb_divider color=&#8221;#007576&#8243; divider_weight=&#8221;5px&#8221; _builder_version=&#8221;4.17.1&#8243; _module_preset=&#8221;default&#8221; width=&#8221;60px&#8221; module_alignment=&#8221;left&#8221; global_colors_info=&#8221;{}&#8221; theme_builder_area=&#8221;post_content&#8221;][\/et_pb_divider][et_pb_text _builder_version=&#8221;4.17.1&#8243; _module_preset=&#8221;default&#8221; animation_style=&#8221;slide&#8221; animation_direction=&#8221;bottom&#8221; animation_intensity_slide=&#8221;5%&#8221; global_colors_info=&#8221;{}&#8221; theme_builder_area=&#8221;post_content&#8221;]<\/p>\n<h2>O PCT<\/h2>\n<p>&nbsp;<\/p>\n<p>PCT je medzin\u00e1rodn\u00e1 zmluva, ktor\u00e1 umo\u017e\u0148uje po\u017eiada\u0165 o patentov\u00fa ochranu s\u00fa\u010dasne vo v\u00e4\u010d\u0161om po\u010dte kraj\u00edn podan\u00edm jedinej prihl\u00e1\u0161ky.
