Medzin\u00e1rodn\u00fd predbe\u017en\u00fd prieskum (\u010dasto ozna\u010dovan\u00fd ako konanie pod\u013ea \u201ehlavy II\u201c) je volite\u013en\u00e1 \u010das\u0165 konania o medzin\u00e1rodnej patentovej prihl\u00e1\u0161ke<\/strong>.<\/p>\n

Konanie IPE<\/strong><\/p>\n

Po prijat\u00ed p\u00edsomn\u00e9ho posudku vypracovan\u00e9ho org\u00e1nom pre medzin\u00e1rodn\u00fa re\u0161er\u0161 (ISA) m\u00f4\u017eu prihlasovatelia na z\u00e1klade vlastn\u00e9ho rozhodnutia po\u017eiada\u0165 o medzin\u00e1rodn\u00fd predbe\u017en\u00fd prieskum. Ide o druh\u00e9 pos\u00fadenie patentovate\u013enosti vyn\u00e1lezu, ktor\u00e9 vypracuje org\u00e1n IPEA, zvy\u010dajne na z\u00e1klade zmenenej verzie prihl\u00e1\u0161ky<\/strong> (v\u0161etky ISA maj\u00fa \u0161tat\u00fat IPEA). V\u00fdsledn\u00e1 spr\u00e1va o patentovate\u013enosti \u010falej pom\u00e1ha prihlasovate\u013eovi pri rozhodovan\u00ed, \u010di vst\u00fapi\u0165 do n\u00e1rodnej f\u00e1zy<\/strong>.<\/p>\n

Cie\u013eom medzin\u00e1rodn\u00e9ho predbe\u017en\u00e9ho prieskumu nie je udeli\u0165 patent alebo zamietnu\u0165 prihl\u00e1\u0161ku, ale z\u00edska\u0165 predbe\u017en\u00fd a nez\u00e1v\u00e4zn\u00fd n\u00e1zor<\/strong>, \u010di sa n\u00e1rokovan\u00fd vyn\u00e1lez jav\u00ed nov\u00fdm<\/strong>, zah\u0155\u0148a vyn\u00e1lezcovsk\u00fa \u010dinnos\u0165<\/strong> a je priemyselne vyu\u017eite\u013en\u00fd<\/strong>.<\/p>\n

Druh\u00fdm cie\u013eom<\/strong> je ur\u010di\u0165, \u010di nevykazuje form\u00e1lne chyby alebo chyby v obsahu<\/strong> medzin\u00e1rodnej prihl\u00e1\u0161ky, napr\u00edklad vo vz\u0165ahu<\/strong> k jasnosti n\u00e1rokov, opisu a obr\u00e1zkov, alebo \u010di s\u00fa n\u00e1roky \u00faplne podlo\u017een\u00e9 opisom.<\/p>\n

Lehota na podanie n\u00e1vrhu<\/strong><\/p>\n

Prihlasovate\u013e mus\u00ed poda\u0165 n\u00e1vrh pr\u00edslu\u0161n\u00e9mu org\u00e1nu pre medzin\u00e1rodn\u00fd predbe\u017en\u00fd prieskum pred uplynut\u00edm neskor\u0161ej z t\u00fdchto leh\u00f4t:<\/p>\n

1.<\/strong> tri mesiace od d\u00e1tumu zaslania spr\u00e1vy o medzin\u00e1rodnej re\u0161er\u0161i a p\u00edsomn\u00e9ho posudku vypracovan\u00e9ho pod\u013ea pravidla 43bis.1 prihlasovate\u013eovi alebo vyhl\u00e1senia uveden\u00e9ho v \u010dl\u00e1nku 17(2)(a); alebo<\/p>\n

2.<\/strong> 22 mesiacov od d\u00e1tumu priority medzin\u00e1rodnej prihl\u00e1\u0161ky.<\/p>\n

Pr\u00edslu\u0161n\u00e9 poplatky, t. j. manipula\u010dn\u00fd poplatok a poplatok za medzin\u00e1rodn\u00fd predbe\u017en\u00fd prieskum, sa platia IPEA s\u00fa\u010dasne s podan\u00edm n\u00e1vrhu.<\/p>\n

Lehota a doru\u010denie<\/strong><\/p>\n

Vy\u0161ehradsk\u00fd patentov\u00fd in\u0161tit\u00fat vyd\u00e1 medzin\u00e1rodn\u00fa predbe\u017en\u00fa spr\u00e1vu o patentovate\u013enosti v lehote do 28 mesiacov od d\u00e1tumu priority, ak:<\/p>\n

\u2022 boli po\u017eadovan\u00e9 dokumenty (\u017eiados\u0165, zmeny a pod.) predlo\u017een\u00e9 v ur\u010denej lehote,<\/p>\n

\u2022 boli \u00fakony vy\u017eadovan\u00e9 IPEA vykonan\u00e9 v\u00a0pr\u00edslu\u0161n\u00fdch lehot\u00e1ch (zaplatenie poplatkov, predlo\u017eenie prekladov, opravy zjavn\u00fdch ch\u00fdb a pod.).<\/p>\n

Poplatky<\/strong><\/p>\n

Poplatky t\u00fdkaj\u00face sa konania pod\u013ea Hlavy II PCT sa platia priamo IPEA (pozri aktu\u00e1lny sadzobn\u00edk poplatkov).<\/p>\n

Udelenie patentu zost\u00e1va v kompetencii n\u00e1rodnej alebo region\u00e1lnej legislat\u00edvy.<\/p>\n

I<\/strong>nternational Search<\/h2>\n

The international search (IS) is carried out by an International Searching Authority (ISA) concerning an international patent application which is filed with a Receiving Office (RO), in order to find the most relevant prior art documents regarding the claimed subject matter in the application.<\/p>\n

The objective of the international search is to discover prior art which is relevant for the purpose of determining whether, and if so, to what extent, the claimed invention to which the international application relates is or is not novel and does or does not involve an inventive step. Based on the above, the International Searching Authority (ISA) establishes either an International Search Report (ISR) or a Declaration of non-establishment of ISR.<\/p>\n

I<\/strong>nternational P<\/strong>reliminary E<\/strong>xamination (IPE)<\/h2>\n

The international preliminary examination (often referred to as \u201cChapter II\u201d) is an optional part of the processing of an international patent application.<\/p>\n

The aim of the international preliminary examination is not to grant or refuse a patent, but to obtain a preliminary and non-binding opinion as to whether the claimed invention appears to be novel, to involve an inventive step and to be industrially applicable.<\/p>\n

S<\/strong>upplementary I<\/strong>nternational S<\/strong>earch (SIS)<\/h2>\n

The supplementary international search service offers applicants the choice to request additional searches from ISAs other than the one that carried out the initial PCT search. This service gives applicants the option of obtaining a more complete overview of the prior art in the international phase by allowing them to have an additional search performed in an ISA\u2019s specialty language.
