Slu\u017eba d\u00e1va prihlasovate\u013eom mo\u017enos\u0165 z\u00edska\u0165 komplexnej\u0161\u00ed preh\u013ead o stave techniky v<\/strong> medzin\u00e1rodnej f\u00e1ze konania, preto\u017ee im umo\u017e\u0148uje z\u00edska\u0165 doplnkov\u00fa re\u0161er\u0161 vykonan\u00fa v jazyku \u0161pecifick\u00e9ho pre dan\u00fd ISA. Vy\u0161ehradsk\u00fd patentov\u00fd in\u0161tit\u00fat je jedn\u00fdm z org\u00e1nov ISA, ktor\u00e9 pon\u00fakaj\u00fa doplnkov\u00e9 medzin\u00e1rodn\u00e9 re\u0161er\u0161e.<\/p>\n

Re\u0161er\u0161<\/strong><\/p>\n

Doplnkov\u00e1 medzin\u00e1rodn\u00e1 re\u0161er\u0161 sa vykon\u00e1va v z\u00e1kladnej dokument\u00e1cii pod\u013ea PCT a prinajmenej v dokumentoch zverejnen\u00fdch v \u010deskom, ma\u010farskom, po\u013eskom a slovenskom jazyku, ktor\u00e9 s\u00fa v datab\u00e1zach VPI<\/strong>.<\/p>\n

Konanie a lehoty<\/strong><\/p>\n

Prihlasovatelia m\u00f4\u017eu org\u00e1n pre doplnkov\u00fa medzin\u00e1rodn\u00fa re\u0161er\u0161 po\u017eiada\u0165 o vypracovanie spr\u00e1vy o doplnkovej medzin\u00e1rodnej re\u0161er\u0161i do 19 mesiacov od d\u00e1tumu podania (priority). Doplnkov\u00e1 medzin\u00e1rodn\u00e1 re\u0161er\u0161 sa vypracuje na medzin\u00e1rodn\u00fa PCT prihl\u00e1\u0161ku tak, ako bola podan\u00e1:<\/p>\n

\u2022 Org\u00e1n pre doplnkov\u00fa medzin\u00e1rodn\u00fa re\u0161er\u0161 (SSA) za\u010dne vykon\u00e1va\u0165 doplnkov\u00fa re\u0161er\u0161 najnesk\u00f4r do uplynutia 22 mesiacov od d\u00e1tumu priority,<\/p>\n

\u2022 spr\u00e1va o doplnkovej medzin\u00e1rodnej re\u0161er\u0161i (SISR) mus\u00ed by\u0165 vypracovan\u00e1 v lehote 28 mesiacov od d\u00e1tumu priority. SISR sa zasiela prihlasovate\u013eovi a Medzin\u00e1rodn\u00e9mu \u00faradu WIPO.<\/p>\n

Poplatok za doplnkov\u00fa re\u0161er\u0161 a manipula\u010dn\u00fd poplatok za doplnkov\u00fa re\u0161er\u0161<\/strong> sa mus\u00ed zaplati\u0165 Medzin\u00e1rodn\u00e9mu \u00faradu WIPO<\/strong> v lehote jedn\u00e9ho mesiaca od prijatia \u017eiadosti o doplnkov\u00fa medzin\u00e1rodn\u00fa re\u0161er\u0161 (pravidlo 45bis.3(c) PCT).<\/p>\n

I<\/strong>nternational Search<\/h2>\n

The international search (IS) is carried out by an International Searching Authority (ISA) concerning an international patent application which is filed with a Receiving Office (RO), in order to find the most relevant prior art documents regarding the claimed subject matter in the application.<\/p>\n

The objective of the international search is to discover prior art which is relevant for the purpose of determining whether, and if so, to what extent, the claimed invention to which the international application relates is or is not novel and does or does not involve an inventive step. Based on the above, the International Searching Authority (ISA) establishes either an International Search Report (ISR) or a Declaration of non-establishment of ISR.<\/p>\n

I<\/strong>nternational P<\/strong>reliminary E<\/strong>xamination (IPE)<\/h2>\n

The international preliminary examination (often referred to as \u201cChapter II\u201d) is an optional part of the processing of an international patent application.<\/p>\n

The aim of the international preliminary examination is not to grant or refuse a patent, but to obtain a preliminary and non-binding opinion as to whether the claimed invention appears to be novel, to involve an inventive step and to be industrially applicable.<\/p>\n

S<\/strong>upplementary I<\/strong>nternational S<\/strong>earch (SIS)<\/h2>\n

The supplementary international search service offers applicants the choice to request additional searches from ISAs other than the one that carried out the initial PCT search. This service gives applicants the option of obtaining a more complete overview of the prior art in the international phase by allowing them to have an additional search performed in an ISA\u2019s specialty language.
