REFUND OF INTERNATIONAL SEARCH FEE
Applicants can receive a refund of the following percentage of the international search fee in respect of their international applications under the PCT:
- 40% if the Visegrad Patent Institute benefits from the results of an earlier national search carried out by any of the National Offices of the PCT Contracting States;
- 50% if the Visegrad Patent Institute uses the results of an earlier international search report or the VPI’s international-type search report.
To benefit from the refund possibility, please indicate on the Form PCT/RO/101 (Request Form) that such earlier search exists and that you request the VPI to take into account the results thereof.
Before filing the Request Form, tick Box No. VII, item 1.1., and indicate the availability of the earlier search in Box No. VII, item 1.2, as the case may be:
- by ticking the 1st and 2nd box if a copy of the results of the earlier search is available to the VPI, or
- by ticking the 7th box if a copy of the results of the earlier search is not available to the VPI, as this requests the Receiving Office to transmit a copy of the earlier search results to the VPI.
If the earlier search report is not readily available to the VPI or to the Receiving Office, furnish the search report to the Receiving Office or to the VPI.
Eligibility to the refund is decided by the VPI at the completion of the international search. The positive decision is communicated to the applicants via form PCT/ISA/213 when the International Search Report is issued. A Search Fee Refund Form is transmitted to the applicant or can be downloaded below.
SEARCH FEE REFUND REQUEST Process
Please note that the request for search fee refund must be submitted within 6 months from the date of the issuance of document PCT/ISA/213 by the VPI. Requests submitted after the 6-month deadline will not be admissible.
